You may only use Our Site (including, but not limited to, the Forum(s)) in a manner that is lawful and that complies with the provisions of this Clause. Specifically:
You must ensure that you comply fully with any and all applicable local, national and international laws and/or regulations;
You must not use Our Site in any way, or for any purpose, that is unlawful or fraudulent;
You must not use Our Site to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software, or data of any kind; and you must not use Our Site in any way, or for any purpose, that is intended to harm any person or persons in any way.
When submitting Posts (or communicating in any other way using Our Site), you must not:
Post or communicate anything that is sexually explicit;
Post or communicate in a way that is obscene, deliberately offensive, hateful or otherwise inflammatory;
Post or communicate anything that promotes or assists in any form of unlawful activity;

We reserve the right to suspend or terminate your Account and/or your access to Our Site if you materially breach the provisions of this Clause or any of the other provisions of these Terms and Conditions. Specifically, We may take one or more of the following actions:
Suspend, whether temporarily or permanently, your Account and/or your right to access Our Site;
Remove any Post(s) submitted by you that violate(s) this Acceptable Usage Policy;
Issue you with a written warning;
Take legal proceedings against you for reimbursement of any and all relevant costs on an indemnity basis resulting from your breach;
Take further legal action against you as appropriate;
Disclose such information to law enforcement authorities as required or as We deem reasonably necessary; and/or any other actions that We deem reasonably appropriate (and lawful).

Any restrictions you may wish to place upon Our use of such information must be communicated to Us in advance and We reserve the right to reject such terms and associated information.
In order to purchase Material on this Website and to use certain other parts of the Website you are required to create an Account which will contain certain personal details (including Payment Information) which may vary based upon your use of the Website. By continuing to use this Website you represent and warrant that:

We neither represent nor warrant that all Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are provided on Our Site however, such indications may not take into account orders that have been placed by other customers during your visit to Our Site.
We make all reasonable efforts to ensure that all prices shown on Our Site are correct at the time of going online. We reserve the right to change prices and to add, alter, or remove special offers from time to time and as necessary. In a tournament where there’s a certain amount of money required to enter a certain percentage will go towards a company leaving to rest for the prize pool.
All prices are checked by us when we process your Order. In the unlikely event that we have shown incorrect pricing information, please note the following:
We will contact you as soon as possible before proceeding with your Order to inform you of the mistake and to ask you how you wish to proceed. We will give you the option to purchase the Services at the correct price or to cancel your Order (or the affected part thereof). We will not proceed with processing your Order until you respond. If we do not receive a response from you within 48 hours we will treat your Order as cancelled and notify you of the same.

Orders, Material Delivery and Cancellation Options
No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us sending to you an order confirmation email, in an event when you purchase “Coins” you will receive an alert confirming your purchase. Only once We have sent you an order confirmation email or alert on site will there be a binding contract between ESTINY and you.
Order confirmations shall contain the following information:
Confirmation of the Material(s) ordered including full details of the main characteristics thereof;
Fully itemised pricing for the Material(s) ordered including, where appropriate, taxes and any other additional charges;
A confirmation of your express request that the Material is made available to you immediately and that this will constitute a waiver of your statutory right to cancel as detailed below.
Material will be made available to use immediately upon our confirmation of your purchase. When completing the order process you will be required to expressly acknowledge that you wish the service to be made available immediately by paying for it. You will also be required to expressly acknowledge that by doing so, you will lose your statutory right to cancel your contract with ESTINY in which situation the refund will not be granted if the “Coins” have been received.
If you are a consumer based in the European Union, you have a statutory right to a “cooling-off” period with respect to the purchase of certain goods and services. This period, if applicable, begins once the contract between the seller and you, the buyer, is formed and ends at the end of 14 calendar days after that date. Under normal circumstances, purchased service on this Website is made available immediately upon Our confirmation of your order. As set, by expressly requesting this, you waive your right to the cooling-off period and may not cancel the contract merely because you have changed your mind.
If the services you use or otherwise receive does not match that which you ordered, you should contact Us immediately via Support or alternatively emailing us at email@example.com and in any event not later than 24 hours after the product being available or receipt. We will rectify the mistake within 24 hours of receipt of your notice or, if the correct Service/Product is no longer available, We will refund the price paid within 72 hours.
If Material contains faults or errors on availability or receipt, you should contact Us immediately via Support or alternatively emailing us at firstname.lastname@example.org and in any event not later than 24 hours after the availability or receipt, providing full details of the fault(s) or error(s). Faults and errors for the purposes of this Clause include, but are not limited to, data corruption, availability of service, serious bugs, and similar issues. The definition does not extend to file incompatibility (unless We have provided incorrect information in this regard) or minor mistakes in the substance (such as spelling errors or visual imperfections) of the Material itself that are the fault of the author, creator and/or owner. In such cases, contact should be made with the author, creator and/or owner and We will not be a party to such contact.
If you purchase Service in error you must inform Us immediately via Support or alternatively emailing us at email@example.com and in any event not later than 12 hours after the confirmation of purchase or receipt and must not use the Material in question during that time in order to be reimbursed within 72 hours. If any use (including, but not limited to using premium features) of the Service during this time period can be traced to your Account, no refund can be provided and you will continue to have access to the Material purchased in error.
Availability of the Website and Modifications
We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and state-mandated censorship.

Where any Content or Material is made unavailable and you are entitled to a refund as a result, We will inform you of the refund due and it will be paid within 3 days using the same method originally used by you. In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.
The rules stated below are the Official Regulations for ‘ESTINY Competitions’ and therefore we encourage anyone participating to carefully read through them. We ESTINY administrate those competitions personally. Our official address is www.estiny.pro
Anyone over 13 years of age is eligible to participate in our contests, however anyone under 18 needs to have their legal guardian’s permission to enter. By entering a contest you agree to those Official Regulations and our decisions regarding the competition. To win a prize we require a winner to meet all of our requirements stated in this document.
The time which we run our contests by CET/CEST (Central European Time Zone) unless stated otherwise on our official website www.estiny.pro . The time of a competition can be however chosen by the players involved and confirmed between them for convenience.
To enter ‘ESTINY Competitions’
A member needs to click “Sign Up” button to confirm his attendance.
One account may enter certain competition once at a time, it may however be signed for more competitions only if those are played one after another.
Participants are prohibited from using automated systems to run the competitions instead of themselves or cheating in any way. If a person is caught cheating, he/she will be immediately disqualified from taking part in competition and may result in having their account suspended.
Person registering an account with ESTINY is the person allowed to use them, we do not allow for accounts to be passed between members and therefore if we have any doubts about a winner’s identity, we may request a proof of you being the authorised account holder.
- Winner selection and notifications
The winners for promotional contest will be selected randomly out of eligible participants. Odds will differ depending on a number of available prizes and amount of members taking part in promotions. ESTINY don’t take responsibility for entrances that didn’t meet conditions of a contest.
We will notify the prize winners personally using email provided during their account’s registration (the participants have to notify us of any changes in their contact information), we will also announce who the winner is on a competitions’ page. The notification will be provided within week after competition finishes. In an event where a winner cannot be contacted within the required time period the prize may be negated.
In an event where a Winner doesn’t meet all the requirements or was disqualified from a competition the prize will go to the next person in line after him/her, however if the winner is chosen at random the winner shall be picked again.
By accepting the prize a winner will agree for ESTINY to use his full name and other personal information including but not limited to advertising purposes or any other media publicity to promote the competition, service etc. without any limitations. If a winner doesn’t wish to have his personal information used in such way we would require an email requesting to keep the information confidential except for his username registered on ESTINY website.
By taking a part in ‘ESTINY Competitions’ a participant agrees not to hold ESTINY, any subsidiary, partners or a prize supplier responsible or take an action against, in events of:
Including but not limited to:
- Financial Loss
- Personal Injury
- Damage or loss of property
ESTINY do not take responsibility for:
- Any information that is incorrect whether the cause came from participant or a by-product of malfunction of software or hardware used by ESTINY.
- Technical errors which can consist of malfunctions of software/hardware or lack of connection, however are not limited to those only.
- Human intervention in any stage of the entry or competition that hasn’t been authorised.
- Any human or technical error that may occur on our end, included, but not limited to things like mistakes in regulations, advertisement or announcement of the winner
- Liability of winner’s inability to accept the prize for any reason.
- Injury or damage to participants or their property that might have been caused regardless if directly or not when taking a part in ‘ESTINY competitions’.
If a member enters the competition and it’s confirmed however data gets lost or corrupted which results in not being able to access the competition a member will be refunded or allowed to join another competition which ESTINY and a member will agree on.
We ESTINY reserve rights to cancel/suspend or modify the competition or any part relating to it. If any part of the competition doesn’t work properly for reasons beyond our control it will be handled accordingly in our sole discretion. We also reserve rights to disqualify an individual if we find him tampering with the competition process or breaching any of regulations stated in this document.
If an individual attempts to destabilise the process of “ESTINY Competitions” he/she may be found of violating the criminal law, and we reserve rights to seek compensation for the damages done.
ESTINY’s failure in implementing these regulations does not permit someone to challenge them.
- Entrant’s Personal Information
TERMS OF TOURNAMENTS
- The details to be included on a form as defined: First Name, Surname, Nick at a ESTINY, bank details or PayPal details along with address.
There’s a variety of possible prizes to be won on ESTINY, those include: cash, tangible and digital.
Prizes are granted to individuals and teams:
- In individual tournaments there will be one winner receiving a prize.
- In an event where the entry fee has been paid by each member of the team the prize will be equally split between the participating members of the winning team
Form of transport in cash prizes is bank transfer or PayPal.
Default split of prize pool in a tournament as stated:
- 1st place = 70% of prize pool
- 2nd place = 30% of prize pool
Split of prize pool between places achieved may be changed depending on Tournament Setting.
- Tangible Prizes will be delivered by postal services or courier on address provided on a redemption form.
- Form of transport used to deliver digital prizes will be email or will be delivered directly on ESTINY website.
In an event when match starts later than both sides anticipated and providing the score before “deadline” will not be possible, participants are required to inform Administration by sending a report on a match card.
In an event where the match will not be played and neither of the sides provides a score before “deadline”, administrator has a right to forfeit both teams which will result in them leaving the competition.
Participants of a match may be considered “late” if they do not join the match within a certain time frame which will be specified in individual tournament.
- Disconnections/Leaving the match
In case players get disconnected, please read specific terms designated for an event.
In case the hosting player gets disconnected, please read specific terms designated for an event.
In case online services are not available (e.g. PS4 and XO networks, ESTINY) which would make it impossible to play the match, all events are being closed and their participants are getting their coins returned in case of pre-paid events. Organiser has the right to solve the problem in another way, about which all players will be informed on ESTINY site.
If one of participating teams leave the game during the match it will mean they lose it by forfeit.
In case any player gets disconnected in the first time in 30 seconds since the match starts, it is recommended to leave the server and play the match again. If players are disconnected again, the match can’t be stopped and disconnected participants need to join during the match.
Incorrect Match Settings
Match (Server) settings will be given in tournament rules. All matches in a tournament shall be played on settings provided by an organiser.
In an event where the match settings will be incorrect, the team noticing the wrong settings should document it by recording a video or taking pictures, including match results, mode, players on a server, server settings and map.
Player or team possessing evidence to wrong server settings should notify opponent as soon as possible.
- In an event where the player/team will not notify the opponent of the wrong match configuration doesn’t have an option to argue with the match score after it’s done.
- Each round being played with the wrong configuration without informing the opponent will not be taken into consideration as a breach of rules by the hosting side.
The rules regarding choosing the host may vary depending on terms specified in the ‘Rules of the Tournament’.
Host may be changed due to technical issues like e.g. low internet speed of the host etc. If a person or a team chosen by the system as a host can’t host the game by any reason what may make the match unplayable, then an opponent is supposed to host the match. Any issues with hosting should be documented by a picture or a video and shared in ‘Report Match’ section with a detailed description.
In case no host is found between participants, players should pick the best host together and play the match.
If there are any arguments about finding a host, players need to contact the administrator immediately by reporting a match or using a chat on a match’s card.
Detailed informations about players and teams hosting the match are listed in rules of specific event they are participating in.
- Breaking the tournament rules, disqualification
On every tournament there will be specific to it tournament rules, included, but not limited tolist of allowed weapons, maps, accessories, number of players etc, they can be found in Tournament’s rules. Get there by clicking on “Terms” button, which is on the Tournament's Page.
Breaking the tournament rules may result in losing a round or disqualification from the competition.
If the rules are being broken, players should leave the match after acquiring evidence (in form of picture or video) of participant breaking the rules. Participant or team which has broken the rules will automatically lose the round. If the rules are broken again in the same way the team will lose.
Reported breach of the rules will be considered only in an event where the match has been stopped immediately and the breach has been reported. In an event where the match will reach its end regardless of rules being broken during the match, the score will be in favour of the winning team.
In an event of rules being broken which resulted in disqualification or ban, player or team does not meet eligibility requirements, even though they win the tournament, they will not receive their prize.
Person signing up the team for the tournament ( Leader or Co-Leader) claims full responsibility for the team’s behaviour during the tournament.. In an event of serious breach of terms of ESTINY by Leader or Co-Leader, the result will be a ban for them and the whole team will be disqualified from the tournament
To ensure great standard of tournaments, Administration of ESTINY reserves the right to disqualify a participant from tournament or issue a ban of an account in other unforeseen incidents, if a participant is deservant of such punishment, which will be judged by Administration of ESTINY.
- Reporting, Match result, Disputed, Evidence
In case the rules are breached during the match, or if it comes to an argument related to the match, Leaders or Co-Leaders need to report it using ‘Match Report’ and provide a detailed description of a problem.
A correctly sent ‘Match Report’ should include:
- Detailed description of the situation,
- Evidence of conversations between teams/users if required,
- Evidence in form of images (e.g. screenshots) or a video
Match result needs to be provided by a Leader or Co-Leader
In an event where users of teams are unable to prove match score both will be disqualified.
‘No show’ is when one of users, team or both teams doesn’t appear on the match in 15 minutes since the start of a match (unless stated otherwise in rules of tournament).
In case an opponent is late more than 15 minutes, the other side has the right to report ‘no show’ including a good evidence of it.
An evidence of ‘No show’, what means the opponent didn’t appear on the match, should be sent in form of a video or a screenshot and include:
- The current time on the console updated via internet
- Lobby or server of the game on which the team was waiting for an opponent
- Friend requests or any other attempts to contact the opponent
- Documented delay time
Reported and verified ‘No show’ will result with a forfeit of a participant who didn’t show up on the match.
If a report regarding ‘No show’ is provided in a period of time shorter than 15 minutes, will be declined straight away by Administration.
ESTINY doesn’t tolerate cheaters and each person caught red-handed on providing a false match results, not valid match reports, wrong GAME ID, using the game glitches, included, but not limited to those listed in terms of tournaments as not-permitted, impersonate as another user or team and a person, who attempts to extort money or any material goods in any way from other users on the site or ESTINY itself, will be given a penalty.
We strongly advice to document all things related to your matches on ESTINY. All conversations should be done in a written form, in case it will need to be provided as an evidence in the future.
Evidence attached to the report should include all elements required to solve the argument by administration.
We suggest recording all matches using the ‘Share’ function at PS4, and ‘Game DVR’ at XO . If it can’t be of use for any reason, matches should be recorded by using external devices (e.g. Smartphone)
All evidence for a ‘Report Match’ should be reported in that particular section on the card of a specific match including the whole description of the problem.

- Image in jpeg or png format
- YouTube Video in form of a URL link..
It is strongly recommended to upload all scores of matches in ‘Upload Media’ section.

The maximum amount of players who can participate in a Tournament as a team is provided in the Tournament rules.
To sign your team up for an event, the amount of people signed up must be equal to the amount required and provided in Tournament rules (e,g, you can’t sign up to a Tournament, if your team has 2 players and the Tournament is 4vs4)
During a match each team is allowed to play with a lack of one player. If the team lacks more than just one player, the match results by their forfeit..
After signing up to the Tournament the squad provided during the ‘Sign up’ process, it can not be changed afterwards.
If a random player joins your lobby during a match you need to quickly ask him to leave the lobby. If this player leaves a lobby/server/game straight away without any interruption in the match, it should be continued. In case when participants do not agree to continue the match since it was stopped, you need to contact administration using ‘Report Match’ section including a URL to the video showing lobby of the game (players taking part in a particular session, the score and the moment when unwanted player have joined a match, date and time of the match).
The team or player, who attempts to delay a match on purpose or interrupts setting a server up by the host will be disqualified from the Tournament.
Participants can not delay playing the match for another time than shown on ESTINY site by an organiser.
Any form of abuse against your opponent will may result in disqualification or ban, depending on an individual judgement of the Administrator.
We advise to participate only in events being organised for a specific region you are living in, so we you keep a good connection during a match (ping).
In case the team who wins the Tournament does live outside of region being allowed in Tournament terms, an organiser has the right to refuse providing them with a reward.
All GAME ID provided on website ESTINY.pro in user’s profile need to be the same as the ones on PS4 and XO.
In case of an individual Tournaments (1vs1) a participant, who uses different GAME ID than the one provided on the site in his profile will be disqualified from the Tournament.
A team can be disqualified if their team played and included a player or players with GAME ID different than the one provided on site, during the whole match or even a single round.
After every finished match an evidence of the score should be provided in ‘Upload attachments’ section.
Uploaded media needs to meet requirements of Evidence policy.
We strongly recommend to report all issues that come up during a match. To do so, use a designated section for it called ‘Report Match’. It can be found on the Match card.
All reports sent needs to meet requirements provided in Evidence policy.
Reports can be viewed by all players participating in a match and administration.
After finished match, the team who provided the score first needs to wait for its acceptance by the opponent.
In case a match has been reported by any of the participating teams related to the score, it is critical to provide evidence of the real score.
In case the score of a match can not be set by participants on their own, it will be submitted by an Administrator.
A match is officially finished when the score is accepted by both teams or Administrator.
If nobody reports the match and the score is not going to be accepted in time (before Deadline) both sides are disqualified from the Tournament.
After every match the opponent can be overly rated using the ‘Rating’ option considering fair play, communication and behaviour during the match. The score of the match should not be the only criterium being considered for rating the opponent. It can be done only by a person who signs the team up to the Tournament.
Each match has its own dedicated chat visible and usable for administration and all players who participate in that specific match.
The “Get Ready” button is there to confirm participation in a tournament. It’s active and clickable only when it flashes red. If it flashes red, but text on the button says ‘Game On’, it is not clickable.
Lack of confirmation of participation by not pressing the “Get Ready” button results in player or a team being excluded from the tournament.
The “Get ready” function will be made available at a certain time before the competition starts, it will be given by an administrator.
Confirmation of participation by clicking “Get Ready” is required only by the users signing up the team to a tournament (Leader / Co-Leader ).
Function “Get Ready” shows in five different variations:
- Get Ready (Grey) - During Sign Up. Inactive
- Get Ready (Red) - Active, however not confirmed
- Ready (Green) - Before the start of tournament, confirmed
- Game On (Red) - During the tournament
- Finished (Grey) - Tournament has ended, inactive
The “Deadline Clock” specifies the time participant has to upload his score. It can be found on match card.
In an event where the score isn’t confirmed by one of the teams after the “deadline”, on which team proceeds in a tournament decides the score already uploaded on a match card.
In an event where neither of the teams uploads the score the system automatically notifies the administrator, which will decide on the response towards the teams.
Each tournament has its individual support. In an event where Administration needs to be contacted in matters relating to a tournament, we recommend to use the “Support” on a Tournament Page. Those messages will go directly to Administrator of a tournament, which will decrease the waiting time to get a response. You can also send a meesage to firstname.lastname@example.org to directly contact the Administrator..
- Individual Rules of Tournament
Each individual tournament has its own specific set of rules dependent on a game, which if broken will result in penalties being distributed on players or teams and can result in prize not being granted to those teams.
Rules of tournament regard every participant taking part, both team and individual matches.
Rules of tournament are available on Tournament Page in a tab named “Terms”.
- Tournament with constant prize pool
Tournament with constant prize pool will not change throughout the course of its existence, once the prize is set, regardless of home many players will participate.
In an event where a player or a team don’t have an opponent in a first round of the Tournament, they will be moved automatically to the second round after the first one finishes
Tournament is generated at the end of “Get Ready” process. During generating of tournament bracket, teams will be randomly assigned in places to keep the right structure of the tournament,
Starting Date and time of a match in tournament bracket is the date and time where the score should be uploaded as per “Deadline” showing on a match card.
- History of Match and Tournament
Tournament history allows an insight into previous tournament played by a certain player or a team.
In an event where team or user’s account participating in a tournament will be blocked or is inactive, in a history there still will be available their Team Name and player name.
In exceptional circumstances where team or user’s account will be banned by an Administrator, in history there will still be available the team name and player nick, however their profiles won’t be available.
Every player joining the tournament agrees to have their nick, user profile, team profile featured on history of tournament, which is available for everyone to see.
Each team participating in tournament agrees to have their team name displayed in history of team matches, users’ profiles, profiles of teams participating in tournaments which is available for everyone to see.
ESTINY gives consent to share the history of matches and tournaments on other sites.
Match only shows up in history of matches after it had reached its end.
Tournament only shows up in history of tournaments after it had reached its end.
Sign up for the tournament is available from the moment tournament is featured on a website to a moment where the “Get Ready” stage begins underneath the tournament card
User signing up for the tournament by clicking “Sign Up” has a duty to read the rules applying to it, in case of team competitions to also inform all participants and ensure they will follow the rules throughout the whole competition. User signing the team up for the tournament takes responsibility for the team and its players.
- Leader of Co-Leader has a right to sign up team to tournaments.
- All players within a team wanting to participate in a tournament need to have a GAME ID on their profile.
- Team that has been banned cannot join the tournaments.
- Team needs to have enough players to be able to join a tournament.
- Winner only receives a prize if he had paid an entry fee (only regarding paid competitions).
- After successful signing up for a tournament Leader / Co-Leader (depending on which one signed up the team) will need to confirm the team status by clicking on “Get Ready”
- Leader / Co-Leader takes responsibility for the team members actions during the competitions.
- Team may only take part in tournament for the game it is created for.
- Player may participate as a part of only one team in certain tournament.
- After successful sign up for a tournament there is no way to change the participants confirmed for competition.
- Player willing to take part in tournament needs to ensure his GAME ID is provided on a profile.
- Banned player doesn’t have an option to join the tournaments.
- Each participant signed up for the Tournament needs to confirm his attendance by clicking ‘Get Ready’ button before the time shown on tournament’s site passes by.
- After successful sign up to a competition player must confirm his participation by clicking on “Get Ready” before the time on tournament page runs out.
ESTINY TV may also be found on site under the term ‘ESTV’.
Content of the streams on ESTINY TV must relate to games featuring on the site or in compliance with the ESTINY’s policies.
ESTINY is not responsible for the content shared by users on the estiny.pro/tv site, however it will do its best to ensure the inappropriate content is removed.
- Organiser's right to transmit gameplays and matches (using their streams)
ESTINY, as an organiser of Tournaments reserves the right to stream all kinds of Plays or Matches being played through ESTINY.pro
- User’s right to transmit gameplays and matches
All users on ESTINY have right to transmit their gameplays and matches without a need to inform the organisers.
- Right to use the content for Marketing Purposes
ESTINY reserves the right to use the users’ streams, recordings, names and nicknames, avatars, teams’ names and their logos in promotional materials and advertisements.
- Advertisement of other products on ESTINY
Streams and recordings shared on ESTINY.pro can’t feature product placement and promotion of items not relate to gaming or promoting services, which could have a negative impact on ESTINY. In that case ESTINY reserves the right to remove the user’s stream without any form of notification.
- Removal of streaming licence
The user has a right to remove his stream at any moment and to do so he needs to contact ESTINY support with a request.
